These General Terms and Conditions govern the use of the Stay Anywhere platform and the brokerage services we provide between hosts and tenants.
These General Terms and Conditions ("GTC") apply to all business relationships between Stay Anywhere GmbH ("Stay Anywhere", "we") and the users of our platform — namely landlords and providers of furnished apartments ("Hosts") and prospective tenants ("Tenants"). By using the platform, registering an account, publishing a listing or submitting an inquiry, the user accepts these GTC in their version valid at that time. Deviating terms of the user do not apply unless we have expressly agreed to them in writing.
The platform is operated by Stay Anywhere GmbH, Koenigsallee 40, 14193 Berlin, Germany. Further details on the provider can be found in our imprint.
Stay Anywhere operates an online platform on which Hosts can present furnished apartments for short- and long-term stays and Tenants can find suitable apartments and contact Hosts. Stay Anywhere acts solely as an intermediary (broker). The rental or usage contract for an apartment is concluded exclusively between the Host and the Tenant. Stay Anywhere does not become a party to that rental contract and is not itself a landlord, tenant or letting agent for its own account.
Certain functions require registration. Users must provide truthful and complete information and keep it up to date. Access credentials must be kept confidential and not passed on to third parties. Stay Anywhere may block accounts in the event of a material breach of these GTC.
Hosts are responsible for the accuracy, completeness and legality of the listings they publish (in particular descriptions, prices, availability, photos and any legally required information). Hosts warrant that they are entitled to let the advertised apartment and that the listing does not infringe the rights of third parties or statutory provisions.
A listing on the platform does not constitute a legally binding offer but an invitation to submit an inquiry. When a Tenant submits an inquiry, Stay Anywhere forwards the relevant data to the respective Host in order to broker the contract. Whether a rental contract is concluded, and on what terms, is decided solely between the Host and the Tenant.
Creating an account, publishing listings and using the platform are free of charge for Hosts and Tenants.
If a rental or usage contract is concluded between a Host and a Tenant as a result of Stay Anywhere's brokerage, the Host owes Stay Anywhere a brokerage commission of 15% of the total value of the concluded contract for the agreed rental period (plus statutory value-added tax, if applicable).
The commission claim arises upon the effective conclusion of the rental or usage contract between the parties. The Host shall inform Stay Anywhere of the conclusion and the total value of the contract without undue delay.

Users may not misuse the platform, in particular they may not publish unlawful, misleading or infringing content, circumvent the brokerage in order to avoid the commission, or impair the technical operation of the platform.
Stay Anywhere is liable without limitation for damage caused intentionally or by gross negligence and for injury to life, body or health. In the case of slight negligence, Stay Anywhere is only liable for the breach of a material contractual obligation (cardinal obligation), and in that case liability is limited to the foreseeable, typical damage. As Stay Anywhere only brokers contracts, it assumes no liability for the performance of the rental contract concluded between Host and Tenant or for the accuracy of listing content provided by Hosts.
The use of the platform is possible for an indefinite period. Users may delete their account and stop using the platform at any time. Statutory rights of termination for good cause remain unaffected. Commission claims that have already arisen remain unaffected by the termination of platform use.

The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If the user is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Berlin. Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. Stay Anywhere may amend these GTC with effect for the future; users will be informed of material changes in an appropriate manner.
